Terms of Service

1. Scope and Acceptance

These Terms of Service ("Terms") constitute a binding agreement between you ("User") and Multiangular UG (haftungsbeschränkt) regarding the use of the Lumino mobile application, the website brainpet.app and all associated features (together, the "Service"). By downloading, installing, registering for or otherwise using the Service, you accept these Terms in full. If you do not agree, please do not use the Service.

2. Description of the Service

Lumino is a mobile application that helps users build a focused-attention habit through a playful "brain pet" companion. The Service may include free and paid features, in-app purchases, subscriptions, AI-assisted features and synchronization across devices. Features may change, be added or removed at any time.

The Service is not a medical product. It is not intended to diagnose, treat, cure or prevent any disease or mental health condition. It is not a substitute for professional medical, psychological or therapeutic advice.

3. Eligibility and Minors

You must be at least 16 years old, or the minimum age of digital consent in your country, to use the Service. Users under 18 must obtain consent from a parent or legal guardian. We may verify age and refuse or terminate accounts that do not meet these requirements.

4. Accounts and Security

Some features require an account. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential and for all activity under your account. You must notify us immediately at mail@multiangular.com if you suspect unauthorized use.

5. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Lumino app on devices you own or control, for your personal, non-commercial use. All other rights are reserved.

You may not (a) reverse engineer, decompile or disassemble the Service except to the extent permitted by mandatory law; (b) copy, modify or create derivative works; (c) rent, sell, sublicense or share access; (d) circumvent technical limitations, rate limits or security; (e) use the Service to build a competing product or to train machine-learning models; (f) use bots, scrapers or automated means to access the Service.

6. App Stores

If you obtained the app through Apple's App Store or Google Play, additional terms of the respective store apply. The store providers are not parties to these Terms and are not responsible for the Service. Where required by Apple, the Apple-specific terms of the End User License Agreement apply additionally.

7. Paid Features, Subscriptions and Right of Withdrawal

Some features are offered as one-time purchases or recurring subscriptions. Prices, billing cycles, renewal and cancellation are displayed before purchase and are processed by the respective app store. Subscriptions renew automatically unless cancelled in your store account settings at least 24 hours before the end of the current period.

Right of withdrawal (consumers in the EU): You normally have a 14-day right of withdrawal for digital contracts. By starting to use paid digital content immediately after purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once performance has begun (§ 356 Abs. 5 BGB).

Refunds for purchases made through an app store are governed by that store's refund policy.

8. User Content and AI Inputs

You retain ownership of content you create or submit through the Service ("User Content"), including notes, sessions and prompts. You grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, process and display User Content solely to operate, secure and improve the Service for you.

You are responsible for your User Content and warrant that it does not infringe third-party rights or applicable law. We may remove User Content that violates these Terms.

9. Acceptable Use

You agree not to use the Service to: violate any law; infringe intellectual property, privacy or other rights; upload malware; harass, threaten or harm others; transmit unlawful, defamatory or sexually explicit material involving minors; interfere with the integrity or performance of the Service; or attempt unauthorized access to other accounts or systems.

10. Availability and Changes

We make reasonable efforts to keep the Service available but do not guarantee uninterrupted, error-free or secure operation. Planned maintenance, technical issues, force majeure or third-party outages may cause temporary unavailability. We may modify, suspend or discontinue all or part of the Service, including features, at our discretion, with reasonable notice where required by law.

11. Beta and Pre-Release Features

Features marked as "beta", "preview" or similar are provided "as is", may contain errors, may change or be removed, and are excluded from any service-level commitment.

12. Health Disclaimer

The Service is provided for general informational and self-improvement purposes only. If you are experiencing symptoms of a mental or physical health condition, please consult a qualified professional. Do not rely on the Service in emergencies.

13. Intellectual Property

The Service, including software, design, trademarks, logos, text, graphics and all other materials, is owned by Multiangular UG (haftungsbeschränkt) or its licensors and is protected by copyright, trademark and other laws. Except for the limited license in Section 5, no rights are granted to you.

14. Third-Party Services

The Service may rely on or link to third-party services (e.g. cloud hosting, analytics, AI providers, app store, payment processors). We are not responsible for third-party services and their terms and privacy policies apply to your use of them.

15. Warranty (Statutory Rights, Germany)

For paid Services to consumers, the statutory warranty for defects under German law (§§ 327 ff. BGB for digital products) applies. Free Services are provided without warranty to the maximum extent permitted by law.

16. Limitation of Liability

We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and within the scope of any guarantee we have expressly given.

For damages caused by simple negligence, we are liable only if we breach a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the User regularly relies). In such cases, liability is limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded. The above limitations apply accordingly to our legal representatives, employees and vicarious agents.

To the extent permitted by law, we are not liable for indirect or consequential damages, loss of data, lost profits or loss of business opportunities. You are responsible for backing up any content important to you.

17. Indemnification

You agree to indemnify and hold harmless Multiangular UG (haftungsbeschränkt) from third-party claims arising out of (a) your unlawful use of the Service, (b) your breach of these Terms, or (c) infringement of third-party rights by your User Content, unless you are not responsible for the breach.

18. Termination

You may stop using the Service at any time and delete your account in the app or by contacting mail@multiangular.com. We may suspend or terminate your access if you materially breach these Terms, abuse the Service, or where required by law. Sections that by their nature should survive termination (e.g. IP, liability, dispute resolution) shall remain in force.

19. Changes to the Terms

We may amend these Terms to reflect legal, technical or business changes. We will notify you of material changes in the app, by email or on brainpet.app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you may terminate your account before the changes take effect.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you reside remain unaffected.

If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Berlin, Germany. The same applies if you have no general place of jurisdiction in Germany or have relocated abroad after conclusion of the contract.

21. EU Online Dispute Resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute-resolution proceedings before a consumer arbitration board.

22. Final Provisions

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force. The invalid provision shall be replaced by a valid one that comes closest to its economic intent.
